About these terms
This website is operated by NY2K Jewellers [LEGAL ENTITY NAME, ABN], Rovera Plaza, Shop 5, 23 Cotton Tree Parade, Cotton Tree, Maroochydore QLD 4558. By using the site or placing an order you agree to these terms. If you do not agree, please do not use the site.
We may update these terms from time to time. The version on this page at the time you place an order is the one that applies to that order.
Orders
An order is an offer to buy. We accept it when we send you confirmation that the order has been dispatched or is ready for collection. We may decline or cancel an order before then, for example if a piece has sold in the studio, if there is an obvious error in the price or description, or if we cannot verify payment. If we cancel an order you have paid for, we will refund you in full.
Most of our pieces are one of a kind and are sold both online and in the studio. Occasionally a piece will sell in the studio before the website updates. If that happens we will contact you promptly and refund you.
Prices and payment
Prices are in Australian dollars and include GST. We accept the payment methods shown at checkout. Payment is taken in full when you order, unless we have agreed a deposit in writing for custom work.
Prices can change without notice, because the cost of precious metals and gemstones moves. A change will not affect an order we have already accepted.
Product descriptions and images
We describe and photograph every piece as accurately as we can. Jewellery is photographed at magnification, so a piece may look larger on screen than in the hand; please check the listed measurements. Colours vary between screens.
Gemstone weights and measurements are approximate. Natural gemstones and pearls carry natural characteristics, and no two are identical.
Custom and remodelling work
Custom and remodelling work is quoted individually, in writing, after a consultation. A quote is based on metal and gemstone prices on the day and is valid for the period stated on it.
Work begins once you have approved the design and paid the agreed deposit. The balance is due before the finished piece is collected or dispatched. Deposits are non-refundable once work or the sourcing of materials has begun, subject to your rights under the Australian Consumer Law.
Timeframes for custom work are estimates. Handmade work depends on the supply of materials and on the piece itself, and we will tell you if a date needs to move.
Where you supply your own jewellery or gemstones for remodelling or repair, we take every care with them. Some stones carry existing flaws or treatments that make them vulnerable when unset, heated or reset. We will tell you about any risk we can see before we begin, and you accept the risks we have explained.
Pieces from other houses
Some pieces we sell are designed and made by other houses, including Autore, Pink Kimberley and Sapphire Dreams, and are identified as such. They are not made by NY2K Jewellers. Certificates and manufacturer warranties supplied with those pieces are issued by the house concerned.
Valuations
Valuations we arrange are prepared by an independent, contracted valuer registered with the National Council of Jewellery Valuers. A valuation is the valuer's opinion for the stated purpose, usually insurance, on the stated date. It is not a statement of resale price.
Delivery, returns and refunds
Delivery is covered by our Shipping Policy. Returns and refunds are covered by our Refund Policy. Both form part of these terms.
Care of your jewellery
Fine jewellery needs care. We recommend having claws and settings checked at least once a year, and removing jewellery before swimming, cleaning, gym work or gardening. Damage from wear, accident or lack of maintenance is not a fault in the piece.
Website content
All photographs, designs, text and video on this site belong to NY2K Jewellers or its licensors and may not be copied or used commercially without our written permission. Original NY2K designs remain our intellectual property, including designs produced for a custom commission, unless we agree otherwise in writing.
Our liability
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
Subject to that, and to the extent the law allows, we are not liable for indirect or consequential loss arising from your use of this website, and our liability for any other loss is limited to the price you paid for the goods or services concerned.
Privacy
We handle your personal information as set out in our Privacy Policy.
Governing law
These terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland.
